Public Offer to Join the Rules of Digital Identification and Use of Identifiers in the OGOGO Digital Platform
Effective from June 01, 2024.

Reference to the previous title: this document was previously titled “Public Offer to Conclude an Agreement to Join the Rules for the Use of a Simple Electronic Signature in the OGOGO Digital Platform”. This version is the updated version of that document. Any references in agreements, applications, user agreements, consents, printed forms or other documents to the previous title shall be deemed references to this Public Offer and the Rules of Digital Identification and Use of Identifiers in the OGOGO Digital Platform.
OGOGO LLC, hereinafter referred to as the “Licensor”, and all financial and credit organizations, leasing companies, trade organizations and other persons participating in the OGOGO Digital Platform, jointly referred to as the “Participants of the OGOGO Digital Platform”, guided by Article 396 and Part 2 of Article 398 of the Civil Code of the Kyrgyz Republic, hereby address this open-ended offer (public offer) to any individual who is a citizen of the Kyrgyz Republic and is hereinafter referred to as the “Client”, to conclude with the Participants of the OGOGO Digital Platform an adhesion agreement to these Rules of Digital Identification and Use of Identifiers in the OGOGO Digital Platform (the “Rules”) in accordance with Article 387 of the Civil Code of the Kyrgyz Republic.
Full and unconditional acceptance of this offer is made by the Client by marking acknowledgement of this offer and/or the Rules in the OGOGO mobile application or another interface of the OGOGO Digital Platform intended for Clients and by confirming the action through an OTP code or another identifier provided by the OGOGO Digital Platform. Such acceptance means that the Client has concluded an adhesion agreement to these Rules with the Participants of the OGOGO Digital Platform, has reviewed the Rules and fully and unconditionally accepts all their terms.
These Rules regulate the use of identifiers, including OTP codes, digital identification and digital authentication when the Client confirms actions, acknowledgement, consent, expression of will, creation, signing and/or sending of digital records and digital documents in the OGOGO Digital Platform. Joining these Rules does not oblige the Participants of the OGOGO Digital Platform to conclude any other agreements with the Client.
This offer remains valid until it is cancelled or a new version is published in the mobile application or on https://ogogo.kg.
1. Terms and Definitions
1.1. OTP means a one-time confirmation code generated by an OTP Aggregator and sent by SMS to the Client’s phone number. In the OGOGO Digital Platform, OTP is used as the Client’s identifier and/or key for digital authentication when confirming actions, acknowledgement, consent, expression of will, creation, signing or sending of digital records and digital documents.
1.2. SMS means the technology for receiving and sending short text messages by mobile phone.
1.3. Client’s phone number means the mobile phone number specified by the Client in the OGOGO Digital Platform or in a financing application, to which the OTP Aggregator sends OTP and SMS messages.
1.4. Client Identifier means an OTP code, phone number, PIN, login or other information used in the OGOGO Digital Platform to link digital records with the Client and to confirm the Client’s actions in the digital environment.
1.5. Digital authentication means confirmation of the link between an identifier and the Client using a key, including an OTP code, password or another confirmation method provided by the OGOGO Digital Platform.
1.6. Digital record means a record in digital form created, processed, sent or stored in the OGOGO Digital Platform.
1.7. Digital document means a digital record whose integrity is ensured by a digital signature or identifier used in accordance with these Rules and the Digital Code of the Kyrgyz Republic.
1.8. Documents means agreements and their annexes, forms, applications, acceptance statements, questionnaires, certificates, consents, invoices, acts, orders, privacy policies, user agreements, decisions, protocols, information sheets and other documents required for registration, submission of an application, financing, purchase of goods or receipt of services in the OGOGO Digital Platform, created as digital records and/or digital documents.
1.9. OGOGO Digital Platform means the OGOGO software, including all of its components, modules, microservices, computer applications, mobile applications OGOGO BUSINESS and OGOGO, the web domain https://ogogo.kg and its subdomains, algorithms, the OGOGO trademark and other parts that are the intellectual property of the Licensor.
1.10. Participants of the OGOGO Digital Platform means the Licensor, trade organizations, financial and credit organizations, leasing companies, insurance companies and other persons lawfully using the OGOGO Digital Platform.
1.11. OTP Aggregator means Nikita Online LLC or another legal entity with which the Licensor or the relevant Participant of the OGOGO Digital Platform has contractual relations for OTP generation and SMS delivery.
1.12. Client means an individual who is a citizen of the Kyrgyz Republic and uses the OGOGO Digital Platform for registration, purchase of goods, submission of a financing application, receipt of services or other actions in the digital environment.
1.13. Licensor means OGOGO LLC, the right holder of the OGOGO Digital Platform.
1.14. Licensee means a financial and credit organization or leasing company that reviews the Client’s financing application and uses the OGOGO Digital Platform under an agreement with the Licensor.
2. General Provisions
2.1. These Rules regulate relations between the Participants of the OGOGO Digital Platform and the Client concerning the use of identifiers, including OTP codes, when confirming actions and working with digital records and digital documents in the OGOGO Digital Platform.
2.2. OTP is used not as a simple electronic signature in the former legislative meaning, but as the Client’s identifier and/or key for digital authentication in accordance with the Digital Code of the Kyrgyz Republic.
2.3. The Client’s entry of an OTP code or use of another identifier in the OGOGO Digital Platform confirms the link between the Client and that identifier and, depending on the action performed, unambiguously indicates the Client’s acknowledgement of the relevant digital record, consent to its content and/or expression of will to create, sign or send such digital record.
2.4. A digital record in which the Client’s identifier is used in accordance with these Rules is recognized as a digital document in the cases and according to the procedure provided by the Digital Code of the Kyrgyz Republic.
2.5. If a document requires signing by a Participant of the OGOGO Digital Platform, such Participant may sign the relevant digital document with a digital signature in accordance with the Digital Code of the Kyrgyz Republic and applicable law.
2.6. Personal data and other digital data of the Client specified by the Client in the OGOGO Digital Platform or received within the OGOGO Digital Platform are used for digital identification, digital authentication, registration, application review, transaction execution, contract performance, obtaining consents and operation of the OGOGO Digital Platform within the limits of the Client’s consents and the laws of the Kyrgyz Republic.
3. Procedure for Using OTP and Other Identifiers
3.1. The OTP Aggregator generates OTP and sends it by SMS to the Client’s phone number.
3.2. The Licensor has no access to OTP generated by the OTP Aggregator until it is entered by the Client in the OGOGO Digital Platform, unless otherwise required by the technical OTP verification process.
3.3. To confirm an action, acknowledgement, consent, expression of will, creation, signing or sending of a digital record or digital document, the Client enters the received OTP during its validity period in the relevant field of the OGOGO Digital Platform and clicks the confirmation, signing, acceptance or other button intended for the relevant action.
3.4. The Client is given no more than 3 (three) attempts to enter a correct OTP, unless another procedure is provided by the OGOGO Digital Platform interface or the terms of a specific service.
3.5. Confirmation by the Client of an action with a mark of acknowledgement and consent to a document and using a valid OTP is deemed the Client’s consent to the terms of the digital record or digital document offered in the OGOGO Digital Platform.
3.6. Upon successful entry of OTP by the Client, the relevant action is deemed confirmed by the Client, and the relevant digital record or digital document is deemed confirmed by the Client’s identifier in accordance with these Rules.
4. Information Storage
4.1. If the conditions set out in these Rules are met, the Licensor records the fact of use of OTP or another identifier in the OGOGO Digital Platform and stores the relevant digital records until their transfer to the relevant Participant of the OGOGO Digital Platform or for the period determined by law, agreement or internal storage rules.
4.2. After confirmation of a digital record or digital document, the Client may download available documents from the personal account in the OGOGO Digital Platform if this function is provided by the OGOGO Digital Platform.
4.3. The OTP Aggregator stores records (logs) of sending OTP to the Client’s phone number, indicating the phone number, date and time of sending.
4.4. The OTP Aggregator stores records (logs) of the result of OTP verification, indicating the date and time of verification.
5. Warranties, Rights, Obligations and Liability
5.1. By accepting these Rules and using OTP or another identifier in the OGOGO Digital Platform, the Client represents and warrants that:
5.1.1. the Client understands that OTP is used as the Client’s identifier and/or key for digital authentication in the OGOGO Digital Platform;
5.1.2. the Client has specified in the OGOGO Digital Platform a phone number owned or lawfully used by the Client;
5.1.3. third parties have no access to the Client’s phone number, mobile device, OTP, passwords or other data required to access the OGOGO Digital Platform;
5.1.4. the Client accepts the risks associated with the use of communication channels, SMS messages and the Internet, including the risk of unauthorized access by third parties to the Client’s phone number, mobile device, OTP or other identifiers.
5.2. The Client must keep OTP, passwords and other data required to access the OGOGO Digital Platform confidential, must not disclose them to third parties and must immediately notify the Licensor or the relevant Participant of the OGOGO Digital Platform of unauthorized access or the risk of such access.
5.3. The Participants of the OGOGO Digital Platform and the Licensor are not liable for consequences arising from the Client providing inaccurate data, using a phone number not owned or lawfully used by the Client, transferring OTP to third parties, third-party access to the Client’s phone number, mobile device or OTP, or failures of telecom operators, the Internet, electricity networks, OTP Aggregator services or other external services, unless such consequences are caused by the fault of the relevant Participant of the OGOGO Digital Platform or the Licensor.
5.4. All relations related to the use of digital identification, digital authentication, identifiers, digital records, digital documents and digital signatures in the OGOGO Digital Platform are governed by these Rules, the Digital Code of the Kyrgyz Republic, other applicable laws of the Kyrgyz Republic and the terms of the relevant documents published or generated in the OGOGO Digital Platform.
